Problems in marriage and legal solutions

Marriages are said to be a seven years itch . People start getting problems in their married life once the initial craze for married life is over. Trivial issues like family problems, dealing with kids education, financial issues and sex related problems begin to arise after some time in a marriage.

The rate of divorce is increasing due to these unsolved trivial issues among the couples. The best solution to deal with these problems is to talk to your partner without hesitation and an open mind on such issues. Many a times by merely discussing such issues get solved but most couples don’t give it a chance and keep cribbing about each other. A happy married life is path to peace, success, joy and the good things in life. Women Playing waiting game in divorce

There were times when a bad marriage break up or divorce meant doom for the women as they had no say in financial assets and property of their husbands. But the proposed amendment in marriage act which allows women to have 50% share in her husband’s property in case of divorce can turn things in women’s favor.

It has been reported that the number of divorce cases have gone down as women are waiting for the final outcome of this proposed act. Some of the women who have filed for divorce have asked their lawyers to go slow with the divorce proceedings.

Men obviously are not happy with this change as they can lose a major chunk of their financial assets to their estranged wife. They also fear that this law may be misused by women for financial benefits. But keeping in mind the general perception  this amendment is a welcome move and may even stop marriages from breaking and stop atrocities on women who have to bear the financial losses post divorce.

Marriage Laws to become more women friendly

The Marital laws in India can be become more women friendly if the proposed bill is passed in Lok Sabha. The bill has already been passed by Rajya Sabha to modify the marriage act and special marriage act which considers marriage breakdown due to irretrievable circumstances as a valid ground for divorce. The bill also proposes that the women should have share in the property owned by the husband.

The bill is a welcome move to empower the women of India who do not have financial security after divorce or marriage breakdown. The share of the wife will be decided by the court keeping in mind the prevailing situation. Although women do not have any right on ancestral property owned by the husband but the value of such property will also be taken into account to decide the final alimony.

This is a very crucial development in terms of women’s right after marriage although bill needs to be passed by lok sabha to become a law.
